Terms of Service

These Terms of Service ("Terms") govern your access to and use of sendthesong.org and the Send the Song services, including our guided creation tool, AI-generated lyrics and music, song previews, purchases, downloads, libraries, and sharing features (collectively, the "Service").

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to make a purchase or enter into these Terms on your own behalf. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization. The Service is not directed to children under 13.

The Service

Send the Song helps you turn personal details, memories, and messages into personalized lyrics and AI-generated music. You can choose creative preferences, review or edit lyrics, listen to limited previews, and unlock a selected full-length recording where available.

AI generation is probabilistic. Results may differ between requests, may not exactly follow every instruction, and may contain errors, similarities, or unexpected elements. We do not guarantee a particular style, duration, voice, emotional effect, quality level, or recipient reaction.

We may improve, add, remove, suspend, or discontinue features. Temporary interruptions may occur because of maintenance, provider availability, security incidents, or circumstances outside our control.

Accounts and Security

Some features require signing in with Google. You agree to provide accurate information and to keep your Google account and device secure. You are responsible for activity conducted through your Send the Song account unless caused by our failure to use reasonable security measures.

Notify us promptly at support@sendthesong.org if you believe your account or an associated share link has been accessed without authorization.

Your Content and Responsibilities

"Your Content" includes names, stories, memories, messages, instructions, lyrics, edits, images, and other material you submit. You retain any rights you already hold in Your Content.

You represent that:

• You have the rights and permissions needed to submit and use Your Content.
• Your Content does not violate another person's privacy, publicity, copyright, trademark, or other rights.
• You have an appropriate reason or permission to provide personal information about a song recipient or another person.
• You will review generated lyrics and media before sharing them.

You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, adapt, and process Your Content only as reasonably necessary to operate, secure, improve, and provide the Service, including through our service providers. This license ends when the content is deleted, except for limited backup, legal, security, and transaction records that we are permitted or required to retain.

Acceptable Use

You may not use the Service to:

• Break the law, facilitate fraud, threaten or harass another person, or invade another person's privacy.
• Create or distribute content that is hateful, defamatory, sexually exploitative, or harmful to minors.
• Infringe copyright, trademark, publicity, privacy, contractual, or other rights.
• Impersonate another person or falsely suggest that a real artist, performer, public figure, or organization created, endorsed, or participated in a song.
• Request a deceptive imitation of a living artist's identity or use generated content to mislead listeners about its origin.
• Upload malware, probe security controls, bypass authentication or payment restrictions, discover private storage paths, or obtain another user's full song.
• Scrape, automate, reverse engineer, resell, or overload the Service except where we have given written permission or applicable law expressly allows it.
• Circumvent preview limits, song-credit requirements, expiration rules, rate limits, or other access controls.

We may remove content or restrict access when we reasonably believe these rules have been violated.

AI-Generated Content and Rights

Generated lyrics, music, voices, audio, and artwork are created using automated systems and third-party providers. Similar or identical content may be generated for other users. We do not promise that generated content is unique, copyrightable, free of third-party claims, or suitable for commercial release.

Subject to these Terms, applicable law, and third-party rights, an unlocked song may be downloaded, kept, played, and shared for your personal, non-commercial gifting and listening purposes. Any commercial exploitation, public distribution, synchronization, resale, monetization, or registration of generated content is at your own risk unless we expressly provide separate commercial terms in writing.

Do not represent an AI-generated performance as an authentic recording by a real artist or person who did not participate in it.

Previews, Unlocks, and Song Credits

A generation request may produce one or more candidates. Preview access is limited and is intended to help you choose a recording. Previews are generally available for up to 3 days and may expire or be removed after that period.

A song credit unlocks the selected full-length recording and associated features described at checkout. A credit is consumed when you confirm the unlock. Unlocking one candidate does not automatically unlock every candidate from the same generation request.

The price, currency, quantity of credits, included features, and any expiration date are shown at checkout and form part of these Terms. Current song packs are one-time purchases unless checkout clearly states otherwise. Credits have no cash value, cannot be transferred between accounts, and may not be resold.

Payments and Refunds

Payments are processed by Stripe or another payment provider displayed at checkout. You authorize the processor to charge the payment method you select and agree to provide accurate billing information. We do not receive or store your full payment-card number.

Except where applicable law requires otherwise or checkout expressly states a different policy, purchases of song credits and unlocked digital content are final once a credit has been redeemed. This is because generation and digital-delivery costs are incurred immediately. If a verified technical failure prevents a confirmed unlock from being delivered, contact support@sendthesong.org so we can investigate and, where appropriate, restore the credit, replace the result, or issue a refund.

Taxes, currency-conversion charges, and payment-provider fees may apply depending on your location and payment method.

Downloads and Sharing

After a recording is unlocked, the Service may allow you to download the selected MP3 and use a personalized sharing page or share link. You are responsible for deciding who receives a link and for ensuring the shared content is appropriate.

Anyone with a functioning share link may be able to access the sharing page without signing in, and recipients may forward the link or save the content. Disabling or deleting a share link cannot recall copies already downloaded, recorded, or independently shared by another person.

Our Intellectual Property

The Service, site design, software, branding, logos, documentation, and other materials we provide are owned by or licensed to Send the Song and are protected by applicable intellectual-property laws. These Terms do not grant you ownership of the Service or permission to use our branding except as needed to identify the Service.

You may provide feedback. You agree that we may use feedback without restriction or compensation, provided we do not publicly identify you without permission.

Content Removal and Account Termination

You may delete songs through available account controls or request account assistance by email. Song deletion is intended to be permanent and may not be reversible.

We may suspend or terminate access, remove content, cancel unredeemed promotional credits, or block transactions if we reasonably believe you violated these Terms, created legal or security risk, engaged in fraud or abuse, or used the Service in a way that could harm another person or the Service. Where practical, we will provide notice and an opportunity to contact support.

Sections that by their nature should survive termination—including payment obligations, intellectual-property provisions, disclaimers, liability limitations, and dispute terms—will survive.

Third-Party Services

The Service relies on third parties for authentication, AI generation, storage, payments, email, analytics, and security. Their services may be subject to separate terms and privacy policies. We are not responsible for outages or independent actions of third parties outside our reasonable control.

Disclaimer of Warranties

To the maximum extent permitted by law, the Service and all generated content are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation.

We do not provide legal clearance for names, lyrics, music, voices, artwork, or other generated content. You are responsible for reviewing content and obtaining professional advice when your intended use carries legal, reputational, or commercial risk.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of Liability

To the maximum extent permitted by law, Send the Song and its providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, data, goodwill, opportunity, or business, arising from or related to the Service.

To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid to Send the Song during the 12 months before the event giving rise to the claim or (b) USD $100.

These limitations do not exclude liability that cannot legally be limited, and they do not reduce mandatory consumer rights.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Send the Song and its service providers from third-party claims, losses, and reasonable costs arising from Your Content, your unlawful use of the Service, or your material violation of these Terms or another person's rights.

Governing Law and Disputes

These Terms are governed by the laws applicable to the jurisdiction in which the operator of Send the Song is established, without regard to conflict-of-law principles. Mandatory consumer protections that apply where you live remain unaffected.

Before starting formal proceedings, please contact support@sendthesong.org and describe the dispute so we can try to resolve it informally. Nothing in this section prevents either party from seeking urgent relief where legally available.

Changes to These Terms

We may update these Terms to reflect changes to the Service, providers, pricing, or law. We will post the revised Terms here and update the date above. If a change materially affects your rights, we will provide additional notice where required. Your continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
